384

Regulation 384 has been revised as follows:


384 Non-conformity, Other than Use

A building or structure which is conforming in use but which does not conform to height, setback, land coverage, parking or similar dimensional requirements of the Regulations shall not be considered to be non-conforming within the meaning of Section 383 and 385 of these Regulations. However, no permit shall be issued nor shall any changes be made on such building or structure that will result in an increase in the non-conformity.

This Regulation:



The original wording of regulation 384 was ambiguous because of the use of the term “area” of non- conformity. Area is a term of measurement specifically related to length times width and is measured in units such as square feet, etc.

It is proposed that the word “area” be replaced with

the word “extent” which clarifies the intent of this section, to state that a non-conformity can not be made worse than it is. By using the term extent, it applies to linear distances (as in setback or building height), area (as in lot coverage), or other units of measure as may apply to those regulations which are measurable and define a non-conformity.
